1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Little Lake Lending ("Company," "we," "us," or "our"), a tribal lending entity wholly owned by the Big Valley Band of Pomo Indians.
By accessing or using our website at littlelakelendingloans.com (the "Site") or applying for our lending products, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use our Site or services.
2. Eligibility
To use our services and apply for a loan, you must:
- Be at least 18 years of age (or the age of majority in your state)
- Be a U.S. citizen or permanent resident
- Have a valid Social Security Number
- Have an active checking account in your name
- Have a regular source of income
- Have a valid email address and phone number
- Not be a resident of a state where our loans are prohibited
Meeting these requirements does not guarantee loan approval. Loan decisions are based on our underwriting criteria.
3. Loan Terms and Conditions
3.1 Loan Agreement
If your loan application is approved, you will receive a separate Loan Agreement that contains the specific terms of your loan, including:
- Principal amount
- Annual Percentage Rate (APR)
- Finance charges
- Payment schedule
- Total amount to be repaid
The Loan Agreement is a separate legal contract that governs your loan. These Terms govern your use of our website and general services.
3.2 APR Disclosure
Our loans have Annual Percentage Rates (APR) that may range from 199% to 490%, depending on your creditworthiness and loan terms. The specific APR for your loan will be disclosed in your Loan Agreement before you accept the loan.
3.3 No Prepayment Penalty
You may pay off your loan early at any time without penalty. If you pay early, you may reduce the total amount of interest you pay.
3.4 Late Payment
If you fail to make a payment by the due date, you may be charged a late fee as specified in your Loan Agreement. Late payments may also be reported to credit bureaus and negatively affect your credit score.
4. Website Use
4.1 Permitted Use
You may use our Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable laws or regulations
- Provide false, inaccurate, or misleading information
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the Site
- Use automated systems or software to extract data from the Site
- Impersonate any person or entity
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
5. Intellectual Property
All content on our Site, including text, graphics, logos, images, and software, is owned by Little Lake Lending or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6. Disclaimer of Warranties
OUR SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that our Site will be uninterrupted, error-free, or free of viruses or other harmful components.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITTLE LAKE LENDING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SITE OR SERVICES.
Our total liability for any claim arising out of or related to these Terms or our services shall not exceed the amount of fees you have paid to us in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Little Lake Lending and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of our Site or services
- Your violation of these Terms
- Your violation of any third-party rights
- Any false or misleading information you provide
9. Tribal Sovereignty and Dispute Resolution
9.1 Tribal Sovereignty
Little Lake Lending is a tribal lending entity wholly owned by the Big Valley Band of Pomo Indians, a federally recognized sovereign Indian tribe. As a sovereign nation, the Tribe possesses sovereign immunity from suit except where specifically waived.
9.2 Governing Law
These Terms and any disputes arising hereunder shall be governed by applicable tribal law and, where tribal law is silent, applicable federal law.
9.3 Dispute Resolution
Before initiating any legal action, you agree to first contact us to attempt to resolve any dispute informally. If we cannot resolve the dispute within thirty (30) days, either party may pursue binding arbitration as set forth in your Loan Agreement.
9.4 Limited Waiver of Sovereign Immunity
The Tribe has provided a limited waiver of sovereign immunity solely for the purpose of enforcing the terms of individual Loan Agreements through the dispute resolution process specified therein.
10. Electronic Communications
By using our Site or services, you consent to receive electronic communications from us, including:
- Loan agreements and disclosures
- Account statements and payment reminders
- Marketing communications (which you may opt out of)
- Notices regarding changes to our Terms or services
Electronic communications satisfy any legal requirement that such communications be in writing.
11. Third-Party Links
Our Site may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of these websites. Your use of third-party sites is at your own risk.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our Site and updating the "Last Updated" date. Your continued use of our Site or services after changes constitutes acceptance of the modified Terms.
13. Termination
We may terminate or suspend your access to our Site and services at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use our Site ceases immediately.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any Loan Agreement you enter into, constitute the entire agreement between you and Little Lake Lending regarding your use of our Site and services.
